NEKRETNINA
Za prodaju nekretnine morate sklopiti
sa nama ugovor o posredovanju
prodaje nekretnine, doznačiti
zemljišni izvadak, osigurati posredniku
i eventualnom kupcu pristup te
razgledavanje nekretnina i platiti
dogovorenu proviziju od prodaje
koja iznosi 2% plus iznos PDV-a.
Mi vam nudimo traženje kupca te
sve radnje uključujući pravne.

Za kupnju nekretnine morate sklopiti
sa nama ugovor o posredovanju

po Vašoj želji te platiti proviziju
od 2% plus iznos PDV-a.

FOREIGN CITIZENS ENTITLED TO PURCHASE
REAL ESTATE IN CROATIA?
Yes, but only after statements
of consent are issued by the Ministry
of Legal Affairs and the Ministry
of Foreign Affairs. These statements
of consent are issued to citizens
of countries with which the Republic
of Croatia has signed a contract
on reciprocity. In extraordinary
cases, statements of consent can
be issued to citizens of other
countries as well. The procedure
for obtaining statements of consent
is as follows:

When
a foreign citizen decides
to purchase real estate
in Croatia a sales contract
is first signed with the
seller or selling party.
At this time the sales contract
does not have to be verified
before a Notary Public.

The
signed sales contract and
any other documentation
relevant to the sales transaction
are sent to the Ministry
of Foreign Affairs in Zagreb.

Once
the Ministry issues a statement
of consent to the buyer,
the buyer (i.e. foreign
citizen) is entitled to
register the real estate
in his/her name at the Land
Registry Department (Katastar)
of the Municipal Court and
pay real estate tax on the
purchase. NB - Foreign citizens
that establish, or have
already established, a company
in Croatia can purchase
or sell real estates on
behalf of this company without
restriction. |
WHAT
IS THE REAL ESTATE PURCHASE
TAX IN CROATIA?
The Republic of Croatia has
a unified tax rate of 5% for
all types of real estate and
respective transactions. The
tax is calculated based on the
agreed upon price of the real
estate as listed in the sales
contract and the estimated book
value of the property which
is established by the tax authority
for the area in which the property
is located. According to the
Law, real estate purchase tax
is paid by either the buyer
or the seller as agreed upon
in the sales contract. In transactions
involving an exchange rather
than a purchase of property/real
estate, a tax of 5% of the value
of the property is similarly
applied.
WHEN
MUST THE REAL ESTATE PURCHASE
TAX BE PAID?
Once the sales contract is signed
by all relevant parties, the
buyer is required to register
the purchase agreement with
the local tax authority within
30 days of the date of sale
on the contract. Registration
can be done through a Notary
Public.
